Arka Agents is an AI-powered development platform that provides multi-agent capabilities for software development tasks. The Service includes:

• Access to AI agents for code generation and development tasks
• Command-line interface (CLI) tools
• Integration with development environments
• Pro subscription features for enhanced capabilities

3. Account Registration

To use certain features of the Service, you must register for an account using your GitHub credentials. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be responsible for all activities under your account

4. Subscription and Payment

4.1 Pro Subscription

The Pro subscription is offered at $29/month and includes enhanced features and capabilities. Subscription fees are:

• Billed monthly in advance
• Non-refundable except as required by law
• Subject to change with 30 days notice

4.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the payment method on file for all subscription fees.

4.3 Cancellation

You may cancel your subscription at any time through your dashboard or Stripe customer portal. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Generate malicious code or harmful content
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Circumvent usage limits or restrictions
• Share account credentials with others

6. Intellectual Property

6.1 Our Property

The Service and its original content, features, and functionality are owned by Arka Agents and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain all rights to the code and content you create using the Service. By using the Service, you grant us a limited license to process your content solely to provide the Service to you.

6.3 Generated Content

Code and content generated by our AI agents is provided as-is. You are responsible for reviewing, testing, and validating any generated content before use in production environments.

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your privacy and handling your data in accordance with applicable data protection laws.

8. Disclaimers and Limitations

8.1 No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability

In no event shall Arka Agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the Service.

8.3 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months prior to the event giving rise to the liability.

9. Indemnification

You agree to indemnify, defend, and hold harmless Arka Agents and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and associated data
• You remain liable for any outstanding fees

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in California.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

13. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
